County commissions may lease, rent, or permit use of county-owned wireless towers to entities that are not associated with foreign adversaries, terrorists, or countries that support international terrorism as designated by federal lists and executive orders

Entities using county wireless towers are prohibited from conducting unconstitutional surveillance and must utilize non-compromised cellular and cybersecurity defense measures to protect critical infrastructure

Technology connected to voting or election management systems cannot incorporate hardware or software designed, produced, or majority-controlled by foreign companies or non-U.S. citizens

County commissions cannot charge fees for tower use by public safety operations (911, law enforcement, ambulance, rescue, firefighting), the West Virginia Department of Highways, or other state agencies, provided they meet the same security requirements

County commissions retain authority to charge fees for other uses, promulgate rules, and may appoint a 3-5 member panel to oversee allocation of county properties
