Preempts local ordinances and private restrictions (including HOA rules) that would prevent or regulate broadband installation and equipment deployment

Requires conservation easement holders to not unreasonably withhold permission for telecommunications facility installation (cables, fiber, conduits, etc.) when it does not adversely affect conservation values of protected property

Allows permission for telecommunications installation on conservation easement land through three methods: easement language, a conservation plan specifying location and depth, or court action for existing easements with prohibitive language

Preserves existing eminent domain rights of broadband providers offering telephone and communications services under state public use statutes
