Joint Committee on Government and Finance, working with the Legislative Oversight Commission on Education Accountability (LOCEA), may direct the Legislative Auditor to conduct periodic performance audits of the West Virginia Department of Education and county boards or local districts using state funding

Legislative Auditor granted authority to inspect all records and accounts of the Department of Education and examine department personnel, while also reviewing productivity and meeting standards

Any legally protected information obtained during audits must be kept confidential by the Legislative Auditor with the same duty as required of the Department of Education

Initial performance audit of the West Virginia Department of Education must be completed by December 1, 2025, with a report delivered to both the Joint Committee on Government and Finance and LOCEA

Effective July 7, 2025 (90 days from passage on April 8, 2025)
