Applies to businesses with over $25 million in annual revenue, those handling data of 50,000+ consumers/households/devices annually, or those deriving 50%+ of revenue from selling personal information

Grants West Virginia consumers the right to access, delete, correct, and obtain copies of their personal information collected by businesses, with responses required within 45 days of a verifiable request

Requires businesses to provide a "Do Not Sell or Share My Personal Information" link on their homepage and prohibits selling or sharing personal data of consumers under 16 without affirmative consent

Prohibits businesses from discriminating against consumers who exercise their privacy rights through denial of services, different pricing, or reduced quality of goods/services

Creates a private right of action for data breaches with damages of $100-$750 per consumer per incident, and authorizes the WV Division of Consumer Protection to impose civil penalties of $2,500 per unintentional violation or $7,500 per intentional violation (tripled for minors)
