Declares all federal laws, executive orders, regulations, and court orders that infringe on Second Amendment rights to be "null and invalid" within West Virginia, specifically those affecting intrastate firearm sales, transfers, accessories, and ammunition

Prohibits state and local law enforcement officers and public employees from enforcing federal firearm regulations on intrastate transactions

Establishes $50,000 civil liability per occurrence against any person or entity (including ATF agents) who deprives West Virginia citizens of gun rights, with the employer responsible for damages if the individual is acting in official capacity

Requires the Attorney General to defend West Virginia citizens prosecuted by the federal government for intrastate firearm transactions and to file civil litigation against federal agents who violate the act

Creates criminal penalties for federal agents who violate the act, including misdemeanor charges with up to $1,000 fine and up to one year incarceration, and waives sovereign immunity as a defense
