Repeals West Virginia's entire Air Pollution Control article (§22-5-1 through §22-5-20), eliminating the state's framework for air quality protection, pollution permits, emissions controls, and enforcement mechanisms

Declares carbon dioxide a "foundational nutrient necessary for life on earth" rather than a pollutant, prohibiting the state from designating or treating CO2 as a pollutant or contaminant

Prohibits West Virginia from pursuing any carbon dioxide reduction targets or "net-zero" measures

Requires the state to encourage and support use of coal, oil, and natural gas for electricity generation, motor fuels, and other purposes

Asserts that current atmospheric CO2 levels of approximately 420 parts per million are "near-historically low" compared to a claimed geologic average of 2,600 parts per million
