Creates state crimes for illegal entry into West Virginia by aliens who unlawfully entered the U.S., with first offense as a misdemeanor (up to $5,000 fine and 1 year jail) and subsequent offenses as felonies (1-3 years imprisonment)

Establishes illegal reentry offense for aliens previously deported or removed, with enhanced penalties (up to $25,000 fine and 3 years imprisonment) for those with prior drug or violent crime convictions

Prohibits probation, parole, community supervision, and deferred adjudication for persons convicted of illegal entry or reentry offenses

Grants civil immunity to state and local officials, employees, and contractors enforcing illegal entry laws, with state indemnification for federal law damages up to $100,000 per person or $300,000 per occurrence

Prohibits enforcement of illegal entry laws at schools, churches, healthcare facilities, and sexual assault examination centers, and allows courts to issue orders requiring aliens to return to their country of origin in lieu of prosecution
