Requires consumers to "opt-in" before their personal financial information can be disclosed or sold by financial institutions, creditors, mortgage lenders, mortgage brokers, or credit reporting agencies

Applies to all consumer transactions involving personal financial information, including sales, leases, and offers of credit for personal, family, household, or agricultural purposes

Mandates that businesses provide consumers with complete information about what personal data is being sold or shared, enabling consumers to actively control the security of their financial information

Establishes criminal penalties of up to $10,000 in fines and/or up to one year imprisonment for each violation, with each instance treated as a separate offense

Allows courts to award reasonable attorney's fees and expenses to consumers who successfully bring claims under the act, while also permitting fee awards to defendants if claims are found to be brought in bad faith
