Prohibits financial institutions with over $100 billion in assets from discriminating against agricultural producers based on greenhouse gas emissions, use of fossil-fuel derived fertilizer, or use of fossil-fuel powered machinery

Creates a rebuttable presumption that any denial or restriction of financial services to farmers by institutions with ESG (Environmental, Social, Governance) commitments violates the law; institutions must prove by clear and convincing evidence that decisions were based solely on ordinary business purposes

Authorizes enforcement by both the Attorney General and Commissioner of Agriculture, with violations treated as civil rights violations and unfair trade practices under existing West Virginia law

Empowers the Commissioner of Agriculture to investigate violations, conduct hearings, issue orders, adopt regulations, and conduct statistical studies on ESG policies affecting agriculture

Establishes civil penalties of up to $10,000 per violation, with authority to seek injunctions and other court orders to enforce compliance
