Requires all West Virginia municipalities to allow at least one accessory dwelling unit (ADU) by right on any lot with a single-family home, effective January 1, 2026

Limits ADU size to 75% of the main home's gross floor area or 1,000 square feet, whichever is less; ADUs may be attached, detached, or internal to the primary dwelling

Prohibits municipalities from imposing requirements such as additional parking, owner-occupancy, matching exterior design, impact fees, or more restrictive building standards than those applied to the main dwelling

Caps application fees for ADU permits at $250, though municipalities may still charge standard building permit fees and require will-serve letters from municipal water and sewer systems

Automatically voids any municipal ADU regulations that conflict with these provisions after January 1, 2026, while preserving applicable building, fire, and public health codes
