Removes the existing prohibition on adding licensed substance abuse treatment beds in counties that already have more than 250 licensed substance abuse treatment beds

Amends the Certificate of Need requirements under West Virginia's health services law

Maintains existing prohibitions on certificates of need for intermediate care/skilled nursing beds, new skilled nursing facilities, intermediate care facilities for individuals with intellectual disabilities, and opioid treatment programs

Allows the Health Care Authority to approve expansion of substance abuse treatment capacity regardless of a county's current bed count
