Maintains existing requirements that private prison operators must obtain written approval from the secretary before operating or providing correctional services

Preserves the right of the state and political subdivisions to continue operating their own prison facilities and correctional services

Continues the ban on private contractors operating facilities for maximum-security inmates sentenced by foreign courts
