Railroad companies are responsible for flagging operations during construction, with broadband providers required to reimburse actual flagging expenses only if the railroad schedules flaggers by the proposed crossing date

No crossing fee is required when construction occurs within a public right-of-way, and a reduced $1,000 fee applies for crossing legally abandoned track

Railroad companies may petition circuit court within 15 days if they claim the fee is inadequate compensation, the crossing causes undue hardship, or creates imminent danger to public health or safety
