WV HB3294

Allows banks, broker-dealers, and investment advisers to delay or refuse transactions for up to 15 business days (with extensions possible) when they reasonably believe financial exploitation of an eligible adult is occurring or being attempted

Defines "eligible adult" as persons 65 years or older, adults subject to protective services, or adults 18+ with substantial mental/functional impairment who have a court-appointed guardian

Requires financial institutions that believe financial exploitation has occurred or been attempted to promptly notify designated state agencies, including the WV Department of Human Services Bureau for Social Services and the WV Attorney General

Permits financial institutions to notify associated third parties (family members, attorneys, trustees, or designated contacts) about suspected exploitation, unless that third party is believed to be involved in the exploitation

Grants immunity from civil, criminal, and administrative liability to financial institutions and their employees for disclosures, transaction delays, or refusals made in good faith under this act, unless they acted with actual knowledge of exploitation or malicious purpose
