Establishes a patient's right to decline medical treatment, diagnostic procedures, or routine examinations from a medical resident in non-emergency situations and receive care from a licensed physician instead

Requires healthcare providers to ask patients in advance of appointments or procedures whether they consent to receiving care from a resident or having a resident observe

Mandates that if a patient declines resident involvement, the procedure or appointment must be rescheduled to when a licensed physician is available

Preserves residents' ability to treat patients in emergency or urgent medical situations regardless of patient preference

Creates new Article 67 in the West Virginia Code establishing these patient rights based on legislative findings that patient comfort and trust improve treatment effectiveness
