Expands West Virginia's civil rights violation statute to add "gender" and "sexual orientation" as protected categories alongside existing protections for race, color, religion, ancestry, national origin, political affiliation, and sex

Prohibits violence or threat of violence against persons or property based on the newly added protected characteristics

Maintains existing felony penalties of up to $5,000 fine and/or up to 10 years imprisonment for willfully injuring, intimidating, or interfering with someone's constitutional rights based on protected characteristics

Applies the same penalties to conspiracies involving assembling to teach techniques capable of causing property damage, bodily injury, or death when intended to violate civil rights

Requires courts to consider bias based on gender or sexual orientation as an aggravating circumstance when imposing sentences for felonies or misdemeanors
