Creates new regulations for "liability shield products," defined as medical, pharmaceutical, biological, or technological products that are immune from liability under federal law (such as certain vaccines)

Requires manufacturers to complete placebo-controlled studies lasting at least five years with safety outcome metrics tracking allergenicity, carcinogenicity, fertility impact, mutagenicity, and other health effects before products can be distributed in West Virginia

Mandates the Department of Health establish a policy by January 1, 2026 to monitor adverse outcomes and publish post-market surveillance data, with manufacturers required to submit study documentation by July 1, 2028 and compliance reports by December 31, 2030

Grants individuals the right to refuse liability shield products without coercion or threat

Authorizes the Attorney General to seek civil penalties up to $100,000 per violation beginning January 1, 2031, and allows individuals who suffer injuries from violations to bring private lawsuits for compensatory damages, injunctive relief, and attorney's fees
