Exempts small format or micro-hospitals from West Virginia's certificate of need (CON) review process when built by health care facilities that already operate one or more licensed hospitals in the state

Limits exempt micro-hospitals to 25 or fewer inpatient beds, 25 or fewer emergency room beds, one CT scanner, one MRI scanner, plus laboratory, diagnostic imaging, and other hospital services

Caps the total cost of exempt micro-hospital projects at $100 million

Requires micro-hospitals to be geographically located in a way that increases care capacity without jeopardizing the provider status of existing critical access hospitals in West Virginia
