Establishes the "West Virginia Critical Infrastructure Protection Act" defining critical infrastructure as physical or virtual systems vital to national or state security, economic security, or public health/safety

Designates 23 categories of critical infrastructure facilities including petroleum refineries, power plants, water treatment facilities, pipelines, telecommunications infrastructure, nuclear reactors, healthcare facilities, airports, and livestock/poultry facilities

Creates misdemeanor penalties for trespassing on critical infrastructure property (fines $250-$1,000 and/or 30 days to 1 year jail), with felony charges for causing damage exceeding $2,500 (fines $3,000-$10,000 and/or 1-5 years imprisonment)

Establishes civil liability for trespassers and for persons or entities who compensate others to trespass on critical infrastructure; includes provisions for forfeiture of personal property used in infrastructure theft or damage

Exempts lawful labor activities including union organizing, picketing arising from bona fide labor disputes, monitoring workplace safety compliance, and contractors performing authorized work at facilities
