WV HJR23

Proposes a constitutional amendment reserving to West Virginia citizens the powers of initiative (proposing new laws and constitutional amendments), referendum (rejecting recently enacted legislation), and recall (removing elected officials from office)

Requires initiative and referendum petitions to obtain signatures from at least 10% of voters in the district based on the most recent gubernatorial election, with statewide petitions needing this threshold met in two-thirds of all counties

Requires recall petitions to obtain signatures equal to 20% of votes cast for the winning candidate in the most recent election for that office

Limits recall elections to no more than one per term and prohibits them within one year of an official's term ending; recalled officials cannot serve the remainder of their term

If approved by two-thirds of the Legislature, the amendment would be placed on the 2028 general election ballot for voter ratification
