Proposes repealing Article XII, Section 10 of the West Virginia Constitution, which currently requires voter consent before creating an independent free school district or organization within existing school districts

Would place a constitutional amendment on the ballot for the 2026 general election for voter ratification or rejection

If approved, independent free schools could be created without obtaining consent from voters in the affected school district(s)

Requires two-thirds approval from members elected to each house of the legislature to place the amendment on the ballot

The proposed amendment would be designated as "Amendment 1" on the 2026 ballot
