Quitclaim deeds without consideration and deeds transferring property valued at $100 or less (with no excise tax paid) must now be signed by the grantee and acknowledged before a county commission clerk, or proved by two witnesses

Deeds recorded in violation of this new requirement are void, and no property interest transfers to the grantee under such improperly recorded deeds

Exemptions apply to transfer on death deeds and certain family transfers (between spouses, parent-child, grandparent-grandchild, including spouses of children/grandchildren) without consideration or for less than $2,000

Effective date is July 11, 2025 (90 days from passage on April 12, 2025)
