Public schools in West Virginia are prohibited from providing instruction related to sexual orientation or gender identity, with exceptions for responding to student questions, providing historical context, addressing disciplinary matters like bullying, and dual enrollment or advanced placement courses

School employees are prohibited from knowingly giving false or misleading information to parents, custodians, or guardians regarding a student's gender identity or intention to transition to a gender different from their biological sex

School employees must report to an administrator any student request for accommodations affirming a gender identity different from their biological sex, including requests to use different names or pronouns; the administrator must then notify the student's parent, custodian, or guardian

Parents or guardians impacted by violations may file complaints under West Virginia Board of Education Policy 7211, and school personnel found in violation may face discipline or dismissal

The Attorney General is authorized to enforce compliance, and the law takes effect July 11, 2025 (90 days after passage on April 12, 2025)
