Lessees or operators of conventional vertical oil, natural gas, or natural gas liquids wells who fail to pay royalties within six months of the due date are liable for treble damages (three times the market value of unpaid royalties)

The treble damages penalty does not apply if there is a bona fide dispute between parties or if alternative damages are specified in a written agreement

Applies only to disputes filed with a court on or after July 1, 2025

Prevailing parties may be awarded reasonable attorney's fees and costs in addition to other remedies

Jurisdiction and venue are proper in the county where the well and leasehold are located; effective July 6, 2025 (90 days from passage on April 7, 2025)
