Expands mandatory DNA collection to all persons 18 and older charged with felonies after grand jury indictment or waiver of indictment, in addition to those convicted of felonies and certain misdemeanors

Requires DNA samples from all persons currently imprisoned in state correctional facilities or jails after felony convictions, as well as sex offenders required to register in West Virginia

Establishes expungement procedures allowing DNA profiles to be removed from databases when charges are dismissed, acquittals are entered, or convictions result in non-qualifying misdemeanors

Authorizes the West Virginia State Police Superintendent to promulgate emergency and legislative rules establishing DNA sample collection procedures for arresting authorities

Specifies that any identification, warrant, probable cause to arrest, or arrest based on a database match remains valid despite failure to expunge or reasonable delay in expungement
