Creates the Mountain Bike Responsibility Act establishing liability framework for commercial mountain biking operations in West Virginia, defining responsibilities for trail system operators, mountain bicyclists, and aerial tramway passengers

Requires trail system operators to maintain trail boards and signage, mark trails by difficulty level, follow industry safety standards, establish emergency operations plans, and carry minimum liability insurance of $100,000 per person, $300,000 per occurrence, and $10,000 for property damage

Mountain bicyclists expressly assume risk of injury or property damage from inherent hazards including uneven terrain, rocks, roots, jumps, collisions with other riders, wildlife, and properly marked structures

Prohibits passengers from boarding tramways while impaired by alcohol or drugs, interfering with tramway operations, or using tramways without proper instruction or safety devices

Allows parents or guardians to sign liability releases on behalf of minor participants, and requires competitors to visually inspect trails before competitions while assuming risk of all terrain conditions
