Establishes parents' fundamental right to direct the upbringing, education, and care (including medical care) of their children under West Virginia law

Guarantees parents the right to choose private, religious, or home schooling as alternatives to public education, and to make reasonable choices within public schools

Prohibits state agencies, localities, or government officials from infringing parental rights unless they can demonstrate a compelling government interest that is narrowly tailored and uses the least restrictive means

Allows parents to sue the state for violations of these rights and seek injunctive relief, monetary damages, and attorneys' fees, or raise the law as a defense in court proceedings

Excludes from protection any parental actions involving child abuse or neglect, attempts to access health care treatments the state has restricted, or actions to end the life of a human being (including abortion-related claims)
