Employers receiving state economic development incentives must allow employees to vote in secret ballot elections conducted by the National Labor Relations Board when selecting union representation, rather than relying solely on signed union authorization cards

Prohibits employers receiving state incentives from voluntarily disclosing employees' personal contact information (home address, phone numbers, email, shift schedules, work locations) to labor organizations without prior written employee consent

Bars employers receiving state incentives from signing neutrality agreements with unions, which would prevent employers from speaking to employees about union issues

Requires the Department of Economic Development to execute separate agreements with incentive recipients reserving the right to recover funds if employers violate these requirements—with 5-year terms for incentives under $25 million and 10-year terms for incentives of $25 million or more

Takes effect July 1, 2025, with exemptions for agreements and labor organizing that occurred prior to that date
