Authorizes West Virginia public higher education institutions to enter into compensation agreements with student-athletes for use of their name, image, or likeness (NIL) and to share athletic department revenues with athletes

Prohibits athletic associations, conferences, or oversight organizations from penalizing, suspending, or declaring ineligible any student-athlete or institution for engaging in NIL activities permitted under this law

Bans student-athletes from earning NIL compensation connected to alcohol, cannabis, tobacco, adult entertainment, controlled substances, performance-enhancing drugs, or gambling/casinos

Prohibits institutions from using state-appropriated funds to compensate student-athletes for NIL activities

Establishes that student-athletes participating in NIL opportunities are not considered employees of the institution, and provides legal remedies including injunctive relief for aggrieved parties
