Requires the West Virginia Department of Education to submit proposed rules for legislative approval under the state's Administrative Procedures Act (§29A-3-1 et seq.)

Prohibits the Department of Education from implementing any rulemaking until the legislative rules have been approved by the Legislature

Maintains existing requirement that the State Board of Education file proposed rules with the Legislative Oversight Commission on Education Accountability

Expands legislative oversight by adding the Department of Education to agencies subject to legislative rule-making review, whereas previously only the State Board of Education had filing requirements
