Nonresident real estate brokers who maintain a definite place of business in their home state are exempt from the requirement to maintain a physical office location within West Virginia

Licensed brokers must still maintain a definite place of business designated on their license certificate and may only transact business at that location or at properly licensed branch offices

Brokers must display branch office licenses conspicuously, keep affiliated associate broker and salesperson licenses in their custody, and notify the commission of any address changes

Associate brokers and salespersons must work under direct supervision of their affiliated broker and cannot perform any licensed activities after termination until a new broker affiliation is approved

Effective date is July 10, 2025 (90 days after passage on April 11, 2025)
