Recycling cooperative associations may be organized as nonprofit corporations, except within a 35-mile radius of a mixed waste processing resource recovery facility permitted by the West Virginia Department of Environmental Protection

Recycling cooperatives are limited to collecting recyclable goods generated by their members that are not already collected by a certified waste motor carrier in the same area

If a motor carrier receives a certificate of need to serve the same area with the same recycling services, the cooperative must cease providing those services

Cooperatives operating continuously for at least 12 consecutive months before a certified waste motor carrier begins providing the same service may continue serving their members under a grandfather provision

Amends the cooperative associations statute (§19-4-1) to add definitions for "goods and services" that include recycling, composting, and repurposing materials
