Birth certificates in West Virginia must list a child's sex at birth as male or female and may not use the term "non-binary"

The sex listed on an original birth certificate cannot be changed as a result of sex change surgery

To obtain a driver's license, identification card, or instruction permit with a sex designation different from sex at birth, applicants must provide medical documentation of gender reassignment surgery and a court order declaring the gender designation

The bill amends West Virginia Code §16-5-10 (Vital Statistics) and §17B-2-6 (Motor Vehicle Driver's Licenses)
