Automatically suspends any existing medical power of attorney for a vulnerable adult when the West Virginia Department of Health and Human Resources opens an adult protective services investigation into abuse, neglect, or financial exploitation

Requires the department to immediately file a medical power of attorney that supersedes any previous medical power of attorney during the investigation period

Permanently invalidates the original medical power of attorney if a court substantiates the abuse, neglect, or financial exploitation allegations

Transfers medical decision-making authority to the department when abuse is court-substantiated, allowing the state to make necessary medical decisions for the vulnerable adult

Amends West Virginia Code sections 9-6-4 and 9-6-5 governing social services for adults and emergency remedial treatment procedures
