Creates the "Residential Treatment Capacity Expansion Fund" as a special interest-bearing revenue account in the State Treasury to expand in-state residential treatment capacity for children

Fund sources include legislative appropriations, recoveries or reimbursements related to residential treatment services, investment income, and public or private contributions

Authorized expenditures include recruiting and incentivizing new residential treatment providers, acquiring or constructing facilities, workforce development and training, and transitioning West Virginia children from out-of-state placements back to in-state settings

Fund balances do not revert to the General Revenue Fund at fiscal year end but remain dedicated to residential treatment capacity expansion

The Secretary of the Department of Human Services authorizes all disbursements and may pay expenses incurred prior to the bill's effective date if consistent with the fund's purposes
