Requires the West Virginia Legislature to convene within 48 hours of any gubernatorial proclamation of a state of emergency to vote on whether the emergency declaration should continue and which actions should be maintained

Limits the Governor's emergency powers to temporary authority only until the Legislature convenes, after which the Legislature assumes control over emergency response decisions

Transfers specific emergency powers to the Legislature, including authority over evacuations, movement restrictions, suspension of state business procedures, and limits on alcohol/explosives sales

Allows the Legislature to authorize the Governor to exercise emergency powers on its behalf, but retains ultimate decision-making authority with the legislative body

Amends §15-5-6 of the West Virginia Code relating to the Division of Homeland Security and Emergency Management, introduced January 21, 2026, by Delegates Anders and Dillon
