Requires West Virginia municipalities to allow at least one accessory dwelling unit (ADU) by right on any lot containing a single-family home, effective January 1, 2027

Limits detached or attached ADUs to 75% of the main dwelling's floor area or 1,000 square feet, whichever is less

Prohibits municipalities from requiring additional parking, owner-occupancy, matching exterior design, impact fees, or restrictive covenants as conditions for ADU approval

Bars municipalities from setting more restrictive building heights, setbacks, lot sizes, or coverage requirements for ADUs than those applying to the primary dwelling

Allows municipalities to charge a one-time application fee of up to $250 per ADU and to require will-serve letters from municipal water and sewer systems
