Grants property owners receiving the credit liability protections under West Virginia's recreational use statute, provided amenities are maintained in safe condition

Authorizes public service districts and the Public Service Commission to inspect facilities and terminate the utility waiver if amenities are not properly maintained or are closed to the public for more than seven consecutive days

Establishes the West Virginia Tourism and Recreation Utility Credit Fund through the Department of Commerce to reimburse public service districts for waived utility revenue, subject to annual legislative appropriation
