Creates the "Second Amendment Preservation Act" declaring federal laws, orders, and regulations restricting intrastate firearm sales, transfers, accessories, or ammunition within West Virginia to be null and invalid

Prohibits state and local law enforcement officers and public employees from enforcing federal firearms regulations that infringe on Second Amendment rights

Establishes $50,000 civil penalty per occurrence against any person or entity, including ATF agents, who deprives West Virginia citizens of their right to keep and bear arms under color of law

Requires the Attorney General to defend West Virginia citizens prosecuted by the federal government for intrastate firearm transactions and to file civil litigation against federal agencies or agents who violate the act

Makes federal agents, contractors, or employees who violate the act guilty of a misdemeanor, punishable by up to $1,000 fine and up to one year incarceration
