Designates psychiatric hospitals as "state-designated facilities" if more than 95% of their average annual inpatient census consists of court-ordered forensic and civil involuntary commitments from state custody or state-owned hospitals

State-designated facility status exempts these psychiatric hospitals from the additional 0.75% health care provider tax imposed on eligible acute care hospitals under the Medicaid directed payment program

Amends West Virginia Code §11-27-38 relating to health care provider taxes and hospital eligibility classifications
