Repeals West Virginia's entire Air Pollution Control Act (§22-5-1 through §22-5-20), eliminating state authority over air pollution prevention, permitting, enforcement, and compliance programs

Declares carbon dioxide a "foundational nutrient necessary for life on earth" rather than a pollutant, prohibiting the state from designating or treating CO2 as a pollutant or contaminant

Prohibits West Virginia from pursuing any carbon dioxide reduction targets, including "net-zero" emissions goals

Establishes state policy to "encourage and fully support" the use of coal, oil, and natural gas for electricity generation, motor fuels, and other purposes

Asserts legislative findings that current CO2 levels (approximately 420 parts per million) are "near-historically low" and that restrictions on CO2 emissions "unnecessarily restrict" economic activity and human flourishing
