Establishes mandatory setback distances for wind turbines from non-participating landowners' property lines equal to 1.1 times the total height of the tower, turbine, and maximum blade height

Requires wind turbines to be set back at least 1.5 times the total combined height from any non-participating landowner's residence (including single/multi-family dwellings, schools, and licensed health-care facilities)

Mandates setbacks of 1.1 times total turbine height from paved public roads and overhead transmission lines of 115kV capacity or greater

Applies only to wind energy systems exceeding 500 kilowatts of potential generation and does not affect siting certificates issued before the effective date

Allows property owners to sign written waivers permitting wind turbines to be placed closer than the minimum setback requirements
