Establishes consumer data privacy rights for West Virginia residents, including the right to request copies of personal information collected, request deletion or correction of data, and opt-out of the sale or sharing of personal information to third parties

Applies to businesses with annual gross revenues exceeding $25 million, those that buy/sell personal information of 50,000+ consumers annually, or businesses deriving 50% or more of revenue from selling consumer data

Requires businesses to maintain and publish an online privacy policy updated at least every 12 months, disclose categories of personal information collected, and inform consumers at or before the point of collection about data use purposes

Prohibits discrimination against consumers who exercise their privacy rights, including denying services, charging different prices, or providing different quality of goods or services

Creates a private cause of action for violations and empowers the West Virginia Division of Consumer Protection to establish enforcement rules and bring suits against violating businesses
