Establishes minimum fire safety requirements for fully enclosed agritourism buildings, including mandatory exits (minimum two for 75-400 occupants), illuminated exit signs, portable fire extinguishers every 75 feet, and emergency evacuation plans posted at all exits

Requires fire alarm detection systems when occupancy exceeds 300 persons and sprinkler systems when occupancy exceeds 1,000 persons

Exempts certain facilities from fire code exemptions, including daycare facilities, correctional facilities, health care facilities, sleeping/lodging facilities, and educational facilities used beyond incidental purposes

Mandates State Fire Marshal or local authority inspection before agritourism businesses can receive exemption from state fire code, with written reports submitted to property owners and the WV Department of Agriculture

Excludes open-air structures from these requirements, including gazebos, pavilions, open-wall barns, greenhouses, high tunnels, and grain storage buildings
