Creates a regulated medical psilocybin program in West Virginia specifically for treating post-traumatic stress disorder (PTSD), administered by the Department of Health with implementation beginning July 1, 2026

Establishes a Psilocybin Production Establishment Licensing Board within the department to review and approve licenses for cultivation facilities and independent testing laboratories, with no more than four testing laboratory licenses permitted

Requires psilocybin production establishments to be located at least 1,000 feet from schools, churches, libraries, playgrounds, and parks, and at least 500 feet from residential zones, with facilities needing $100,000 performance bonds for cultivation or $50,000 for testing laboratories

Mandates registration of qualified medical psilocybin providers (physicians, physician assistants, nurse practitioners) to recommend treatment and qualified therapy providers (including psychologists and social workers) to administer psilocybin in secure therapy locations

Implements comprehensive tracking requirements including real-time inventory control systems with unique identifiers, tamper-proof video recording stored for at least 45 days, and criminal background checks for all establishment owners, directors, and agents
