Requires all existing administrative rules to automatically expire on a staggered schedule (one-third at 2, 4, and 6 years after enactment), with new rules expiring after 5 years unless affirmatively renewed

Agencies must prove by clear and convincing evidence that each rule is statutorily authorized, necessary, least restrictive, cost-beneficial, non-duplicative, and clearly written to obtain renewal

Creates a 12-member West Virginia Regulatory Review and Sunset Commission appointed by the Governor, Speaker of the House, and Senate President to conduct audits, evaluate renewal petitions, and recommend mass repeal legislation

Establishes regulatory burden budgets requiring agencies to repeal or reduce existing regulatory burdens equal to any new burdens imposed before new rules can take effect

Grants citizens standing to sue over rules maintained in violation of the act, with prevailing plaintiffs awarded attorney's fees, and prohibits courts from deferring to agency interpretations
