Creates an Office of Public Defense within the West Virginia State Police to acquire and sell machineguns to qualified members of the public for state defense purposes

Authorizes the office to purchase military-style firearms including AR-15/M16-platform, M249-type, and MP5-type machineguns and sell them through State Police Troop Headquarters locations statewide

Imposes a $250 surcharge plus up to $50 administrative fee on each machinegun sale, with proceeds deposited into a newly created Public Defense Fund in the State Treasury

Requires background checks for purchasers and mandates that persons who become prohibited from firearm possession must return their machinegun to State Police within seven days

Exempts transfer records from public disclosure under the Freedom of Information Act and requires destruction of personally identifiable information five years after transfer, except for certificates of ownership
