Defines "homemade food item" as food for human consumption produced and packaged at the producer's residential property, excluding alcoholic beverages and food containing drugs

Exempts homemade food items from state licensing, permitting, inspection, packaging, and labeling laws when sold directly to consumers or through third-party vendors

Requires labeling with content, sources, potential allergens, and a statement that the product was made in a non-commercial kitchen that may not be subject to inspection

Allows sale of potentially hazardous homemade foods containing meat, poultry, or dairy only when sold directly by the producer to the consumer and delivered in person, with transport limited to two hours at appropriate temperatures

Preserves authority of local health departments and the Department of Agriculture to investigate foodborne illness reports and cease production or sale of implicated items
