County commissions in West Virginia would be authorized to lease, rent, or permit use of county-owned wireless towers to private entities, expanding beyond the current limitation to nonprofit organizations only

Entities using county wireless towers are prohibited from having any direct or indirect association with foreign adversaries, terrorist exclusion lists, state sponsors of terrorism, or individuals/entities designated under terrorism-related executive orders

Tower users must refrain from unconstitutional surveillance activities and must employ non-compromised cellular and cybersecurity defense measures to protect critical infrastructure, including voting and election management systems

Technology connecting to voting or election systems may not incorporate hardware or software designed, produced, or controlled by foreign companies, foreign-controlled domestic companies, or non-U.S. citizens

Public safety operations (911, law enforcement, ambulance, rescue, firefighting), the West Virginia Division of Highways, and other state agencies must be permitted free use of tower space, provided they meet the same security requirements
