Requires any individual determined to be in the country illegally by local, state, or federal law enforcement in West Virginia to be immediately turned over to Immigration and Customs Enforcement (ICE) for deportation

Creates a felony offense for individuals apprehended a second time after being previously determined to be in the country illegally

Establishes a penalty of 3 to 5 years in a state penitentiary for the second offense, followed by immediate transfer to ICE for deportation upon release

Prohibits state entities, local entities, and law enforcement agencies from overriding this article or federal immigration policy

Adds a new Article 17 titled "Illegal Immigration" to Chapter 61 of the West Virginia Code
